Shipping Policy

A Legal Disclaimer

It Is A Gallery operates under French law and arranges the shipment of artwork to clients worldwide. While every effort is made to ensure that each piece is securely packaged and properly handled, once an artwork is released to a third-party shipping or transport provider (the “Carrier”), It Is A Gallery disclaims all liability for any loss, damage, delay, or deterioration that may occur during transit.
 

Responsibility and risk for the artwork transfer to the purchaser or client at the moment the Carrier collects the item from It Is A Gallery or its designated storage facility. It is a Gallery shall not be held responsible for any acts, omissions, negligence, or incidents—whether foreseeable or not—on the part of the Carrier or any other party involved in the transportation and transit process.
 

Clients are encouraged to obtain independent insurance to protect against potential transit-related risks. At the client’s written request, It Is A Gallery may assist in arranging insurance through a third-party provider; however, any such coverage will be subject exclusively to the insurer’s terms and conditions. It Is A Gallery does not guarantee coverage, approval, or compensation under any insurance policy not directly issued by it.

 

Upon receipt of the artwork, the client is responsible for promptly inspecting the shipment for any signs of damage, loss, or irregularity. Any such issues must be reported directly to the Carrier in accordance with their established claims procedures. While It Is A Gallery may, upon request, assist by providing supporting documentation, it bears no responsibility for any damage incurred during transit and shall not be held liable for the resolution or outcome of any claim submitted to the Carrier.
 

This disclaimer shall be governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with the shipment of artwork shall be subject to the exclusive jurisdiction of the competent courts in Paris, unless otherwise required by mandatory provisions of applicable law.

Shipping Policy and Legal Disclaimer 

This Shipping Policy constitutes a legally binding agreement between It Is A Gallery, a company organized under the laws of France, and any customer purchasing artwork through our services (the “Customer”). By placing an order with It Is A Gallery, the Customer acknowledges and agrees to be bound by the terms set forth below. This policy is intended to create clear expectations regarding shipping, delivery, risk, and liability. It serves as the legal framework governing the transport of all artwork purchased from It Is A Gallery.

 

General Provisions

It Is A Gallery is committed to delivering artworks to customers worldwide using professional and reputable third-party shipping carriers. All shipments are subject to the terms and conditions of this policy, in addition to any terms and conditions of sale or consignment agreed upon at the time of purchase. This policy is intended to protect both parties—ensuring the Customer understands what to expect, and enabling It Is A Gallery to deliver services with consistency and clarity.

 

Shipping Methods and Delivery Timeframes

Shipping methods, estimated delivery times, and costs will be provided prior to order confirmation. All delivery timeframes are estimates and are not guaranteed. Delays may occur due to customs processing, weather conditions, or other factors beyond the control of It Is A Gallery. It Is A Gallery does not guarantee delivery on or by a specific date unless expressly confirmed in writing.

 

Transfer of Risk and Liability

All risk of loss or damage passes to the Customer upon release of the artwork to the designated carrier at the point of origin. Once the shipment leaves our premises or designated storage facility, It Is A Gallery shall not be held liable for any loss, theft, damage, delay, or mishandling that may occur during transport.

Customers are encouraged to arrange for appropriate shipping insurance. Upon request, It Is A Gallery may assist in procuring insurance through a third-party provider; however, It Is A Gallery shall not be held responsible for the adequacy of such insurance or the outcome of any related claim.

 

Inspection and Claims

Upon receipt of the shipment, the Customer is responsible for immediately inspecting the artwork for any visible signs of damage or irregularity. All concerns must be reported directly to the carrier and handled in accordance with the carrier’s claims process.

It Is A Gallery may provide reasonable assistance in facilitating the claim, including supplying necessary documentation, but assumes no responsibility for damages incurred during transit and accepts no liability for any decisions made by the carrier or insurer.

 

Undeliverable or Returned Shipments

If a shipment is returned to It Is A Gallery due to an incorrect address, failure to collect, refusal of delivery, or any reason attributable to the Customer, the Customer will be responsible for all additional shipping costs incurred, including return and re-shipment fees. No refunds will be issued for shipping costs associated with failed deliveries resulting from Customer error or inaction.

 

International Shipments and Customs

For international orders, the Customer is solely responsible for complying with any applicable import laws, taxes, duties, or customs fees imposed by the destination country. It Is A Gallery shall not be liable for delays caused by customs authorities or for any fees incurred as a result of the importation process.

 

Force Majeure

It Is A Gallery shall not be liable for any failure or delay in shipping or delivery due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, labor strikes, governmental actions, wars, pandemics, or disruptions to transportation networks.

 

Governing Law and Jurisdiction

This Shipping Policy shall be governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with this policy or any shipment shall be submitted to the exclusive jurisdiction of the competent courts located in Paris, unless otherwise required by mandatory consumer protection laws.
